Welcome to www.millertymefishingcharters.com (the “Website”). By booking a charter, accessing, or using this Website, you agree to be bound by the following Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
1. Booking and Payment
Full payment of charter is required to secure your fishing charter reservation.
Payments can be made via credit card, debit card, or other accepted methods listed on our Website.
Prices are subject to change without notice, but once your charter is confirmed, your rate is locked in.
2. Cancellation and Refund Policy
Customer-Initiated Cancellations:
Full Refund (minus a $50 processing fee): Customers who cancel their charter more than 14 days prior to the scheduled trip date will receive a full refund, less a $50 non-refundable processing fee.
50% Refund: Cancellations made between 7 and 14 days prior to the scheduled trip date will receive a 50% refund of the total charter cost.
No Refund: No refunds will be issued for cancellations made within 7 days of the scheduled trip date or for no-shows on the day of the charter.
Cancellations Due to Weather:
The captain reserves the sole right to cancel or reschedule a trip due to unsafe weather conditions. This includes, but is not limited to, severe storms, high winds, dense fog, or hazardous sea conditions.
If your trip is canceled by the captain due to weather, you will have the option to:
Reschedule your charter for a mutually agreed-upon date and time, subject to availability.
Receive a full refund, including the processing fee.
Cancellations Due to Mechanical Issues:
In the unlikely event of a mechanical issue with the vessel that renders it unsafe or unable to operate, the captain reserves the right to cancel the charter.
If your trip is canceled due to mechanical issues, you will have the option to:
Reschedule your charter for a mutually agreed-upon date and time, subject to availability.
Receive a full refund, including the processing fee.
Cancellations Due to Sickness or Emergency:
We understand that sudden illness or emergencies can occur. If you need to cancel within 7 days of your trip due to a verifiable illness or emergency, please contact us as soon as possible.
While a full refund may not be possible due to the short notice, we will do our best to find a fair resolution, which may include rescheduling your trip (subject to availability) or issuing a partial credit for a future charter on a case-by-case basis. Documentation, such as a doctor's note, may be requested.
Other Considerations:
Millertyme Fishing Charters reserves the right to cancel or terminate a trip at any time if the captain deems the behavior of the passengers unsafe or inappropriate. In such cases, no refund will be issued.
We strongly recommend that all passengers consider purchasing travel insurance to protect against unforeseen circumstances that may lead to cancellation.
No Shows: Failure to appear for your scheduled charter without notice will result in forfeiture of all payments.
3. Charter Conditions
All participants must follow the captain’s safety instructions at all times.
We reserve the right to terminate a charter without refund if participants engage in unsafe, illegal, or inappropriate behavior.
Alcohol consumption is allowed in moderation; no illegal drugs are permitted on board.
4. Assumption of Risk and Liability Waiver
Participation in fishing charters involves inherent risks including, but not limited to, motion sickness, sun exposure, slips or falls, or injury from fishing equipment.
By booking a charter, you acknowledge these risks and agree to hold harmless Miller Tyme Fishing Charters, its owners, employees, and affiliates from any liability for injuries, damages, or losses incurred during your trip.
Hold Harmless Agreement:
In consideration for being permitted to participate in a fishing charter with Millertyme Fishing Charters, the undersigned (hereinafter referred to as "Participant") hereby agrees to the following:
Assumption of Risk: The Participant understands and acknowledges that boating and fishing activities involve inherent risks, dangers, and hazards, which may include, but are not limited to:
Exposure to sun, wind, rain, and other weather conditions.
Movement of the vessel, including waves, wakes, and sudden changes in motion.
Slips, trips, and falls on deck or while boarding/disembarking.
Contact with fishing equipment, hooks, and marine life.
Potential for injury or illness.
Actions or omissions of other participants or third parties.
The possibility of unforeseen circumstances.
Release of Liability: The Participant, for themselves, their heirs, executors, administrators, and assigns, hereby fully and forever releases, discharges, and holds harmless Millertyme Fishing Charters, its owners, operators, employees, agents, and representatives (hereinafter collectively referred to as "Millertyme Fishing Charters") from any and all claims, demands, actions, causes of action, damages, losses, expenses, and liabilities of any kind or nature whatsoever, whether known or unknown, arising out of or in any way connected with the Participant's participation in the fishing charter, including but not limited to any injury, illness, death, or property damage, even if such injury, illness, death, or property damage is caused by the negligence, whether sole or concurrent, of Millertyme Fishing Charters.
Indemnification: The Participant agrees to indemnify and hold harmless Millertyme Fishing Charters from and against any and all claims, demands, actions, causes of action, damages, losses, expenses, and liabilities (including attorneys' fees and costs) arising out of or in any way connected with the Participant's participation in the fishing charter, including but not limited to any damage to the vessel or equipment caused by the Participant's actions or omissions.
Medical Treatment: In the event of injury or illness, the Participant authorizes Millertyme Fishing Charters to administer or obtain necessary medical treatment for the Participant, and the Participant agrees to be responsible for all costs associated with such treatment.
Acknowledgement of Understanding: The Participant acknowledges that they have carefully read and fully understand the terms of this Hold Harmless Agreement and that they are voluntarily signing this document with full knowledge of its significance.

Unauthorized use of the Website may give rise to a claim for damages and/or be a criminal offense.
6. Privacy
Your privacy is important to us. We do not sell or share your personal information except as required to fulfill your reservation or comply with legal obligations.
